This distance sales agreement (hereinafter referred to as the "agreement") is concluded between the person who is the user of the FastsApp application (hereinafter referred to as the "application") (hereinafter referred to as the "Buyer") and the owner of the application (hereinafter referred to as the "Seller")."
The subject of this agreement is the sale of the product or service that the Buyer will purchase from the Seller using the application. The application is a shortcut application that directs numbers not saved in the Buyer's address book to WhatsApp chats.
The agreement is valid from the moment the Buyer starts using the application.
FastsApp is a utility program that enables communication via WhatsApp with any desired number. With FastsApp, you can access WhatsApp chats without saving numbers to your contacts. All you need to do is enter the number you want to chat with into the program on WhatsApp.
No fee is required to use the application. However, a certain number of credits is required for using the application. Initially, 10 credits are allocated to the Buyer's account. This credit number can be increased by watching advertisements. One credit is deducted from the user's account for each use of the application. For ad-free and unlimited credits, the Buyer must purchase a premium membership. The premium membership fee is collected via the payment method selected by the Buyer. The Buyer must pay the premium membership fee through the chosen payment method. The payment process is carried out through the application's payment system.
The FastsApp application is ready for immediate use once downloaded by the Buyer.
The Buyer has the right to withdraw within 14 days after purchasing a premium membership. The withdrawal period is calculated from the date of purchase within 14 days. The Buyer who wishes to exercise the right of withdrawal must notify the Seller in writing. In the event of exercising the right of withdrawal, the Seller shall refund the amount paid by the Buyer within 14 days.
The application is provided as is. The Seller will make efforts to correct any errors in the application. However, there is no guarantee that the application will function completely error-free.
The Seller takes necessary technical and administrative measures to protect the personal data provided by the Buyer during the use of the application.
The Seller may terminate the agreement regarding the use of the application if the Buyer acts in violation of the agreement. The agreement is considered terminated when the Buyer stops using the application. In the event of termination of the agreement, the Seller shall not be liable for refunding the amount paid by the Buyer for using the application.
This agreement becomes effective upon the Buyer's acceptance of the agreement by using the FastsApp application and is binding between the parties.
This agreement has been prepared in accordance with the Turkish Commercial Code and the regulations on distance contracts in force in Türkiye. The parties acknowledge that they have read, understood, and accepted the provisions of this agreement, and they are considered to have signed the agreement by using the application.
The Seller reserves the right to modify the provisions of this agreement. If the Buyer does not agree to the changes in the agreement, they may terminate the agreement by discontinuing the use of the application.
The application is subject to the Seller's intellectual property rights. The Buyer may not infringe upon the Seller's intellectual property rights by using the application. The Seller reserves the right to take any legal and punitive measures against any potential infringement of intellectual property rights by the Buyer during the use of the application.
The Buyer has the right to communicate any complaints, suggestions, or issues that may arise during the use of the application to the Seller. Contact information will be provided by the Seller within the application.
The Buyer undertakes to act in accordance with the law and not to misuse the application while using it. The Buyer may not infringe upon the rights of third parties or hold the Seller responsible for any damages incurred by these individuals as a result of using the application.
The Seller will exercise due diligence to correct any errors in the application. However, the Seller cannot be held liable for damages resulting from errors in the application.
In the event of force majeure, that is, events occurring beyond the reasonable control of the parties, rendering them unable to fulfill their obligations arising from the contract, one party must immediately inform the other party in writing. Due to force majeure, the parties may temporarily suspend their obligations arising from the contract.
The Buyer agrees that the personal data provided during the use of the application will be processed by the Seller in accordance with the Privacy Policy. The Privacy Policy is available within the application.
This agreement is subject to Turkish Law. Istanbul Courts and Enforcement Offices are authorized to resolve disputes between the parties.
As a result, the use of the FastsApp application is regulated by this agreement. The Buyer accepts this agreement by using the application and commits to usingthe application in accordance with the law. Failure to comply with the provisions specified in the agreement entitles the parties to terminate the contract.
This distance sales agreement is deemed accepted by the Buyer upon commencing the use of the application.
